Deep Services SA (hereinafter: the Company) invites the customer to read these terms and conditions carefully.

All orders placed by telephone, internet, e-mail or with one of our advisers are governed by the present terms and conditions of sale.

By placing an order, the customer acknowledges having read, understood and accepted them, without reservation.

For access to products reserved for professionals, confirmation of training in the form of a diploma or certificate for the use of such products will be required.
The Company reserves the right not to send items that do not comply with the diploma(s) submitted.


1. Order

The Company reserves the right, at its discretion, to suspend an order, particularly in the event of unpaid invoices or insolvency.

Any modification of the order requested by the customer can only be taken into consideration if it is received by the Company before the products are dispatched.


2. Marketed products

The Company reserves the right at any time to add new products, to delete all or part of the products sold or presented in its catalog, to modify them with the aim of improving them, to change their presentation or to cease marketing them, without being obliged to give prior notice to the customer.

 The photographs, texts, illustrations and graphics in the catalog illustrating the products are for information purposes only and are not contractually binding.

Changes may occur between photographs and actual products.


3. Price indication

Our prices are in Swiss francs (CHF), including VAT and excluding shipping and handling costs.

Discount prices are only valid on the same item number.

The Company reserves the right to modify its prices at any time, without prior notice. Products will be invoiced on the basis of the prices in force at the time the order is placed.

Customers may also benefit from special offers on certain products during certain periods, subject to availability.


4. Payment

All orders are payable in Swiss Francs (CHF).

Payment for goods and services may be made by credit card, bank transfer or any other means of payment accepted by the company's merchant site.

Deep Services SA guarantees the confidentiality of the customer's payment information and undertakes to use it solely for the purposes of the commercial transaction.


5. Customs duties

Any applicable customs duties or import taxes are not included in the stated delivery costs and are payable by the customer.

Customs or import taxes are due as soon as the parcel reaches its destination country. The Company has no control over these taxes and cannot predict them, as customs policies vary greatly from one country to another.

The customer must pay any additional customs duties. For further information, the customer should contact the relevant authorities in his/her country.


6. Liability

Dans le cas de livraisons internationales, la Société n'assume aucune responsabilité si les produits ne sont pas conformes aux lois et règlements du pays de livraison, ou en cas d'incompatibilité électrique ou autre d'un produit.


7. Delivery

Goods are sent to the address indicated by the customer.

Shipping and transportation costs are the responsibility of the customer. Whatever the mode of transport, goods travel at the customer's risk.

Delivery is made by post or carrier within ten days. Deadlines are set in good faith and as precisely as possible. The Company shall not be held liable for delays in delivery attributable to a third party to the contract, such as a carrier, or for any other event of force majeure. 

Deliveries are made subject to availability and on a first-come, first-served basis.

In the event of an out-of-stock situation for one of the products ordered, the Company will inform the customer and, unless otherwise instructed by the customer, will proceed with partial delivery of the order. As a general rule, orders cannot be cancelled in the event of stock shortage.

Products that cannot be delivered will be sent with a subsequent order or at the Company's expense.


8. Receiving products

It is the customer's responsibility to check the conformity and condition of the products dispatched without delay.

In general, any reservations or observations made on the delivery note must be complete and precise. In particular, they must define the damage.


9. Return of goods

The customer has 7 working days to inform the Company of any technical anomaly or error in the reference delivered. The customer must indicate the invoice number and date.

The Company will only take back unused products in their original packaging and in perfect condition.

The costs and risks of return shipment are borne by the customer.

The return of goods entitles the customer to a credit note, but under no circumstances to a cash refund.


10. Warranty

Items for which a guarantee is indicated in the description are guaranteed for the specified period. Other items are not guaranteed.

During the warranty period and upon presentation of the invoice, defects will be eliminated free of charge by the Company, unless we prefer to replace the defective item with defect-free goods. All other claims are excluded.

The warranty does not cover damage resulting from ageing or improper use and/or treatment.

No warranty is given for products which have not been purchased directly from the Company.


11. Product resale

The customer undertakes not to resell the products purchased to other professionals without the Company's written consent.


12. Autonomy of provisions

The invalidity of any provision of these general terms and conditions shall not invalidate the general terms and conditions themselves or affect the validity of the other provisions.

The invalid provision will be replaced by the corresponding legal provision.


13. Changes to the general terms and conditions

The Company reserves the right to adapt and modify these terms and conditions at any time.

Each order placed after publication by the Company of the new version of its general terms and conditions of sale constitutes acceptance of the latter. 


14. Applicable law & Jurisdiction

These terms and conditions are governed by Swiss law. In the event of a dispute, DEEP SERVICES SA shall have exclusive jurisdiction.
